Peruvian Farmer Suing RWE Over Climate Change Impacts

Peruvian farmer Saúl Luciano Lliuya is suing German energy company RWE, claiming its role in climate change endangers his farm due to increased flood risks from melting glaciers. The case, backed by Germanwatch, challenges RWE’s emissions accountability and may set a precedent for future climate lawsuits.

A pivotal climate lawsuit commenced on Monday in Hamm, Germany, where Peruvian farmer Saúl Luciano Lliuya is suing the energy firm RWE, alleging its contribution to climate change has endangered his agricultural livelihood. Supported by the climate organization Germanwatch, Lliuya asserts that the accelerated melting of the Palcaraju Glacier near Huaraz poses a flood threat to his crops, prompting him to seek $3.5 million for a flood control initiative.

RWE, which generates less than half a percent of global emissions primarily from coal, argues that its level of responsibility should only entail a contribution of $18,500 for flood protections. However, a 2021 study established a direct correlation between climate warming and the glacier’s retreat, indicating an increasing flood risk in Huaraz, according to lead researcher Rupert Stuart-Smith from the University of Oxford.

The company is phasing out coal operations and contends that it is unjust to hold any single emitter accountable for climate change impacts. RWE stated, “If such a claim were to exist under German law, it would also be possible to hold every motorist liable.” Although an initial ruling dismissed the lawsuit, a regional court in Hamm has now permitted it to proceed, indicating the potential for significant legal implications.

Should Lliuya prevail, it may establish a landmark precedent, according to Seb Duyck from the Center for International Climate Law. He noted that the legal principles addressed in this case could influence future claims against climate polluters globally, as communities become more proactive in seeking reparations for climate-related damages.
